OFFICIAL RULES NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. 1. Eligibility: Broadway Is Back Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty (50) United States (including District of Columbia) thirteen (13) years of age or older at the time of participation. Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees and Members of League of American Theatres & Producers, Inc. or other companies associated with the promotion of the Sweepstakes, as well as the immediate family (spouse, parents, siblings, and children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Sweepstakes is subject to federal, state, provincial, and local laws and regulations. 2. Sponsor: League of American Theatres & Producers, Inc., 226 West 47th Street, New York, NY 10036. 3. Agreement to Official Rules: Participation in the Sweepstakes constitutes a participant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. 4. Sweepstakes Period: The Sweepstakes begins at 12:00 p.m. ("Eastern Time" or "ET") on or about November 29, 2007 and ends at 11:59 p.m. ET on December 17, 2007 (the "Sweepstakes Period"). Sponsor's computer is the official time keeping device for the Sweepstakes. 5. How to Enter the Sweepstakes: During the Sweepstakes Period, visit www.ilovenytheatre.com (the "Site") and complete an online entry form to receive on entry into the Sweepstakes. Limit: Limit one entry per person, per household, per email address, per day during the Promotion Period. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's plays and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Administrator and will not be returned. 6. Winner Selection: One (1) winner will be selected in a random drawing on or about December 18, 2007 from among all eligible entries received. Decisions of the Sponsor are final and binding. Winner will be notified by email at the email address provided. Failure to respond to the initial verification e-mail within five (5) business days of date of notification or return of e-mail notification as undeliverable after three (3) attempts will result in disqualification. In the event that a potential winner of a sweepstakes prize is disqualified for any reason, Sponsor may award the prize to an alternate winner by random drawing from among all remaining eligible entries. 7. Verification of Potential Winner: Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email after the date of random drawing. The potential winner will be required to sign and return to Sponsor, within seven (7) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If the potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. 8. Prize: One (1) GRAND PRIZE: Winner and guest will receive the following prize: two (2) tickets to two (2) Broadway shows (subject to availability), hotel accommodations for two (2) nights (subject to availability) in a hotel located in New York City (hotel chosen solely by the Sponsor, standard room/double occupancy), round-trip standard air transportation to/from gateway airport nearest winner's home in the Continental United States to airport near New York City on Continental Airlines. Restrictions on air transportation prize: If winner is located within 150 miles of New York City, winner will not be awarded air transportation to New York City; rather winner will be awarded up to $200 to cover ground transportation costs to New York City (based on need). Restrictions on hotel prize: If the winner wishes to stay in the hotel for more than two (2) nights, the winner must make his or her own arrangements and is responsible for all costs associated with the extra night(s). General restrictions: Trip subject to availability and blackout dates and will specifically not be available until after January 7, 2008. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, food and beverages, personal charges at lodging, security fees, taxes gratuities, or other expenses or incidentals are the sole responsibility of winner. Travel companion must be 18 years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. Total Approximate Retail Value of the prize depends, in part, on the value of the transportation; Approximate Retail Value the prize: $1,500. Prize is non-transferable or refundable, must be accepted as awarded and have no warranty; no cash redemption and no prize substitutions allowed, except by Sponsor who reserves the right to substitute a prize of equal or greater value if the prize is not available for any reason. All taxes, other costs and expenses on prize are winner's sole responsibility. Odds of winning will depend on number of eligible Entries received. If prize winner is a minor, the prize will be awarded to the winner's parent or legal guardian. Then the minor prize winner must have the parent or legal guardian accompany them to New York as the travel companion. 9. General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize in a random drawing of all eligible participants at the time of the impairment. The Sponsor is only responsible for awarding the prize set forth above. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. In the event of a dispute as to any registration, the authorized account holder of the e-mail address used to enter will be deemed to be the participant. Release and Limitations of Liability: Except where prohibited, by participating in the Sweepstakes, participant agrees to release and hold harmless the Sponsor, its related companies, and each of its respective officers, directors, employees, and agents (collectively, the "Released Parties") from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant's participation in the Sweepstakes or receipt or use of any prize. Except where prohibited, participant agrees that: (a) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in the Sweepstakes but in no event attorneys' fees; and (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation. 11. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate New York State Court located in New York; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. 12. Privacy: Sponsor collects personal information from you when you enter the sweepstakes. The information collected is subject to the privacy policy of Sponsor at www.ilovenytheatre.com. 13. Results: For the name of the winner, send a stamped, self-addressed envelope to: Broadway Is Back Sweepstakes c/o League of American Theatres & Producers, Inc. 226 West 47th Street, 6th Floor, New York, NY 10036 available after December 19, 2007 and before February 1, 2008. |
